2. Scope & Our Hybrid Sales Model

These Terms and Conditions apply to every offer, quotation, order, and agreement between Beemaz.studio and the buyer, whether initiated through our website checkout or via direct email/form inquiries.

Important Note on Our Hybrid Model & Country Availability

To accommodate art collectors globally while ensuring secure, premium logistics, our studio operates on a hybrid sales model based entirely on your geographic location. This means our sales tracks run simultaneously depending on your country at the time of purchase:

  • Active Automated Checkout Countries: Currently, direct online purchasing and automated checkout are strictly limited to the Netherlands. Order requests and payments placed through our website cart do not form an immediate contract and are subject to manual validation and final acceptance by the studio.
  • Orders from All Other Countries: For all other countries, automated checkout is unavailable. Sales are processed manually via our inquiry-based system. A binding contract is concluded only when Beemaz.studio issues a manual digital invoice via email, and the buyer clears the full payment within forty-eight (48) hours.
  • Future Expansion: As our studio grows, additional countries will be added to our automated checkout system. Changes to country eligibility will be updated directly on this page and on our Shipping Policy page, applying immediately to all new transactions.

Incorporation of Policies

Our standalone Shipping Policy and Refund and Return Policy, as displayed on our website, are fully incorporated into these Terms and Conditions. By finalizing your order through either purchase track, you legally accept all rules, exclusions, timelines, liabilities, customs obligations, and costs outlined in those respective policies.

If any provision within these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Nothing in these Terms limits your statutory rights under mandatory applicable consumer protection laws. 

3. Products & Artistic Characteristics

Beemaz.studio offers original abstract and textured artworks, and occasionally limited editions or commissioned works.

  • Handmade & Textured Nature: Each artwork is entirely unique and handmade. Variations in color, texture, surface depth, edges, gloss, and overall finish are inherent to the creation process.

  • Intentional Elements: Structural features such as small drying cracks, fine hairline traces, heavy layering marks, or surface irregularities are deliberate, intentional components of the artistic style. They are not considered defects, flaws, or damages, unless they materially compromise the physical, structural integrity of the canvas or support panel.

  • Digital Representation & Variations: We make every reasonable effort to ensure that the images and descriptions of our paintings on our website are as accurate as possible. However, please be advised that the exact color, brightness, contrast, and visual texture of the physical artwork may vary from the images displayed on your screen. This is due to individual monitor/device settings, ambient lighting, and the unique nature of the painting materials. Consequently, slight variations in color, tone, depth, or texture do not constitute a product defect or a lack of conformity, and do not entitle the buyer to a free return, replacement, or seller-funded shipping compensation. Any return based on such variations will be treated strictly as a standard, buyer-funded change-of-mind return under our Refund and Return Policy.

4. Availability & Orders

All artworks are unique, one-of-a-kind pieces and subject to final availability. To protect the studio against logistical constraints or inventory errors, the receipt of a payment does not constitute a legally binding contract.

Contract formation is governed strictly by the following rules:

  • For Web Checkout: The automated email notification sent by Shopify immediately after checkout is an acknowledgment that your order request and payment have been received. A legally binding contract is only concluded when Beemaz.studio manually reviews, accepts, and confirms your order via a separate email, or when the artwork is physically dispatched, whichever occurs first. We aim to review and confirm all order requests within 14 business days of receipt. If we cannot accommodate the order, it will be canceled, and a full refund will be issued.

  • For Email/Inquiry Orders: A binding contract is concluded only when Beemaz.studio issues a custom digital invoice or quotation via email, and the buyer clears the full payment within forty-eight (48) hours, subject to final manual verification by the studio.

  • Third-Party Freight Forwarding Requests: If an international buyer provides a physical shipping address inside the Netherlands belonging to a commercial freight forwarding warehouse, cargo exporter, or reshipping service to bypass our country blocks, the transaction is processed under the Web Checkout track. The payment and checkout remain a non-binding order request subject to manual validation and acceptance at our absolute discretion. Our complete transfer of risk and fulfillment obligations for these specific orders is governed by Section 6.

  • Cancellation Rights: We reserve the right to cancel or refuse an order request prior to shipment in cases of evident pricing errors, item unavailability, suspected fraudulent activity, or incorrect/incomplete billing information. If an order request cannot be accepted or is canceled by us after payment has been completed, a full refund will be initiated to your original payment method. For standard orders within the European Union, the refund will be completed within a maximum of 14 calendar days. For international orders outside the European Union, the refund may take longer due to cross-border banking procedures, currency conversions, and third-party intermediary networks; Beemaz.studio is not liable for clearing delays caused by these international financial systems.

5. Prices, Taxes & Payment

  • Currency and VAT: All prices displayed on the website are denominated in Euros (EUR) and include Dutch VAT (BTW) where applicable.
  • Payment Processing: Secure payment must be completed depending on your active purchase track:
    • For Web Checkout: Full payment must be securely completed at checkout via the automated payment gateways available on our website before an order request can be reviewed.
    • For Email/Inquiry Orders: Full payment must be completed via the secure custom digital invoice payment link or the manual bank transfer instructions provided directly in our correspondence email.

  • Verification: We reserve the right to perform standard verification checks and cancel transactions if payment clearance cannot be fully confirmed.

  • Shipping Fees & Logistics Tracks: Delivery within our active automated checkout zone (the Netherlands) is provided free of charge to the buyer. For orders from all other countries, custom shipping and handling fees are calculated on a case-by-case basis and explicitly added to your manual email invoice.

  • Price Adjustments: We reserve the right to change the prices of our artworks at any time without prior notice. The price charged for an artwork will be the exact price displayed at the moment the order request is finalized on the website or formally quoted via email.

6. Shipping, Delivery & Risk Transfer

  • Delivery Timelines: Delivery timelines provided at website checkout or quoted via email are estimates and cannot be legally guaranteed.
  • Shipping Logistics & Restrictions:
    • For Web Checkout: We strictly ship to the destinations actively available at website checkout and outlined in our standalone Shipping Policy.
    • For Email/Inquiry Orders: Shipping destinations, costs, and methods are verified and calculated on a case-by-case basis and explicitly added to your custom email invoice prior to payment.
  • Third-Party Freight Forwarding Liability Cutoff: If a buyer utilizes a commercial freight forwarding warehouse or international reshipping service located within the Netherlands, our delivery guarantees, courier safety tracking liabilities, and transit risk transfer obligations terminate completely the moment the package is successfully delivered to that designated Dutch address. Beemaz.studio assumes absolutely no responsibility, logistical support, or financial liability for any subsequent international transit, customs hold-ups, border tariffs, re-packaging damage, or loss occurring after that initial warehouse drop-off.
  • Logistics Network Verification: Beemaz.studio reserves the right to cancel orders and issue full refunds for any purchases originating from or requesting delivery to regions where our primary logistics network (including Sendcloud and its carrying partners) cannot guarantee standard door-to-door tracked fulfillment or where active international trade sanctions apply.
  • Delays & Failures: Beemaz.studio is not liable for transport delays or delivery failures caused by shipping carrier operations, customs clearance procedures, incomplete or incorrect address details provided by the buyer, or force majeure events.
  • Risk Transfer: Risk of loss or damage to the artwork transfers to the buyer upon successful physical delivery to the designated shipping address.


7. Caring for the Artwork

To ensure your full refund, the artwork must be returned in its original structural condition.

  • Viewing Your Art: You are so welcome to unpack and inspect the painting closely to establish its nature, details, and characteristics—exactly as you would enjoy and inspect a piece up close in a physical art gallery.

  • An Artistic Note on Texture: As you examine your painting, please note that structural features such as small drying cracks, fine hairline traces, heavy layering marks, or surface irregularities are deliberate, intentional components of the artistic style. These unique characteristics are what make original mixed media pieces so special and are not considered defects, flaws, or damages.

  • Protecting the Canvas: To protect the unique texture and structure, please refrain from installing hanging wires, hammering nails into the frame, screwing on mounting brackets, or making any alterations to the canvas while deciding. Please note that adding any hardware or making changes permanently alters the piece and is classified as physical damage.

8. Inspection & Transport Damage

  • Inspection Duty: The buyer is required to carefully examine the exterior packaging and the artwork immediately upon delivery.

  • Reporting Window (Consumers): We strongly urge and request consumer buyers to notify us via email at Beemaz.studio@gmail.com within 48 hours of receipt. While consumer statutory rights remain protected under Dutch law up to a maximum discovery reporting window, immediate notification is critical to enable us to successfully file a carrier damage dispute with our logistics provider (Sendcloud/carriers).

  • Reporting Window (Business/B2B Buyers): For all corporate, business, or professional purchases, structural transit damage must be reported strictly within 48 hours of physical delivery. Failure by a business buyer to report damage within this 48-hour window completely voids any eligibility for compensation, replacements, or claims against Beemaz.studio.

  • Post-Delivery Care Exclusions: Beemaz.studio is not responsible or legally liable for any material degradation, physical cracks, warpage, or damage occurring after successful, undamaged delivery. This includes issues caused by improper handling, incorrect wall mounting/hanging systems, exposure to internal ambient moisture, water damage, extreme radiator heat, direct shifting sunlight, or accidental impact within the home or office.

9. Right of Withdrawal (EU Consumers Only)

  • 14-Day Window: If you are a consumer residing within the EU, you have the right to withdraw from the purchase agreement without giving a reason within 14 calendar days from the day you receive the artwork.

  • Notification: To exercise this right, you must send a clear, written notification via email to Beemaz.studio@gmail.com before the 14-day period expires.

  • Return Period: You must safely return the artwork to our studio within 14 days following your withdrawal notification.

  • Return Conditions and Packaging Mandate: The artwork must be returned completely undamaged. We urge buyers to return the artwork packed securely within its original, pristine protective packaging. If the original packaging is no longer available, the buyer is expected to use identical, professional-grade, multi-layered protective materials (including a glassine/silicone paper protective layer directly against the texture, heavy-duty bubble wrap, corner guards, and a sturdy, double-walled corrugated cardboard box).

  • Return Shipping Costs: The buyer is fully responsible for arranging and paying all return shipping costs. Because of the high value and fragile nature of original art, Beemaz.studio strongly advises buyers to ship returns via a fully trackable, registered courier service with signature delivery. Please note that under EU consumer rules, the buyer assumes full financial risk for the artwork until it is safely delivered back to our studio.

  • Refund Processing & Inspection Timeframes: Once you notify us of your return, we will process your refund within 14 calendar days from the date we receive either your official receipt of return shipment or the actual artwork back at our studio, whichever happens first. Because each painting is a one-of-a-kind original with heavy textures and delicate layers, all returns undergo a mandatory physical inspection upon arrival.
  • Value Depreciation: To protect the unique nature of our original artwork, buyers are legally liable for any diminished value of the artwork under EU consumer rules. If the artwork is returned damaged due to inadequate packaging, negligent transport, or unauthorized physical alterations made at home (as detailed under "7. Caring for the Artwork"), Beemaz.studio reserves the right to deduct this value reduction (up to 100% of the purchase value if the canvas cannot be resold) directly from the customer's refund. Where a refund has already been issued before inspection, Beemaz.studio reserves the right to separately invoice the buyer for any value reduction identified upon receipt of the artwork.


  • Exclusion for Custom Art: The right of withdrawal does not apply to specially commissioned or custom-made artworks built entirely outside of our website's standard menu options, nor to personalized modifications. All sales for commissioned or personalized artworks are final.

  • Customs Duties and Non-Refundable Expenses: For deliveries outside the European Union, the buyer is solely responsible for all import duties, local taxes, or customs clearance fees levied by the destination country upon arrival. All custom international shipping fees paid to Beemaz.studio, as well as all localized customs fees, clearance tariffs, and import taxes paid by the buyer to border authorities, are strictly non-refundable under any circumstance, including standard returns. If you are returning an artwork from an inquiry country outside the EU, you are responsible for ensuring the package is declared as "Returned Goods" with the courier; any customs fees or import taxes levied on our studio due to incorrect declaration will be deducted directly from your refund.

10. Legal Guarantee & Liability

  • We comply with all mandatory Dutch and European legal guarantees. If an artwork arrives structurally defective or materially non-compliant with its description, contact us immediately with your order number, a clear description of the issue, and photographic evidence. We will provide an appropriate statutory remedy.
  • To the maximum extent permitted by applicable law, Beemaz.studio is not liable for indirect, incidental, or consequential damages, including but not limited to loss of profit or revenue.
  • Our total liability under any agreement shall never exceed the total financial amount paid by the buyer for that specific order.

11. Intellectual Property

  • All intellectual property rights, copyrights, and reproduction rights to the artwork remain exclusively with the artist (Beemaz.studio).
  • The purchase of a physical artwork does not transfer copyright, reproduction rights, or commercial exploitation rights to the buyer. You may not copy, print, reproduce, or commercially utilize the artwork without prior written consent.
  • Beemaz.studio retains the right to use digital images of all sold artworks for documentation, portfolios, archival tracking, and promotional purposes.

12. Force Majeure

We are exempt from liability for delays or failures to perform our obligations resulting from events beyond our reasonable control, including natural disasters, war, regional strikes, pandemics, systemic transport failures, or government restrictions. In such events, we reserve the right to cancel the order and issue a full refund.

13. Business B2B Purchases

  • Exclusion of Consumer Rights: If a purchase is made on behalf of a business, commercial entity, or for professional use (indicated by entering a company name or corporate VAT number at web checkout or providing these details for an email invoice), standard EU consumer protection regulations—specifically the 14-day right of withdrawal—do not apply.
  • Final Sale: All B2B (Business-to-Business) transactions are considered final, and returns or cancellations will not be accepted unless the artwork arrives with verified structural defects.

14. Complaints & Disputes

For complaints, please contact us directly at Beemaz.studio@gmail.com. We aim to respond within 14 days. If a consumer complaint cannot be resolved mutually, you can register the dispute for free alternative mediation via WebwinkelKeur at webwinkelkeur.nl.

15. Governing Law

These Terms and Conditions are governed exclusively by Dutch law. Any legal disputes that cannot be settled via the consumer mediation paths mentioned above will be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.

16. Privacy & Data Protection

Data Processing: We take your privacy seriously. All personal data collected during the order and checkout process (such as your name, billing address, email, and payment details) is handled strictly in accordance with our separate Privacy Policy and compliance with the General Data Protection Regulation (GDPR).
